1 About these Terms
These Terms of Use govern your access to https://shop.buildant.net (the Website) and purchases made through it. The Website is operated by Build Ant Design SDN BHD (we, us or our). Please read these Terms before using the Website or placing an order. By using the Website, you agree to the terms applicable to that use. You must accept these Terms before placing an order. If you do not agree, please do not place an order. Our Privacy Policy explains how we handle personal data.
2 Eligibility and accounts
You must be at least 18 years old and legally able to enter into a contract to place an order. If acting for a business, you confirm that you are authorised to bind that business. Provide accurate contact, billing and delivery information and keep it current. You are responsible for protecting your account credentials and must promptly notify us of suspected unauthorised use. You are not responsible for activity to the extent caused by our failure to meet applicable legal obligations.
3 Products and availability
We take reasonable care to describe products accurately. Images are illustrative and colours may vary between screens. Product specifications, sizes, materials, compatibility and any installation requirements are stated on the relevant listing. Check these details before ordering. Products are subject to availability. Any services or installation must be expressly included in the order or separately agreed in writing. Nothing in these Terms permits us to supply goods materially different from the agreed description.
4 Prices and payment
The currency, product price, applicable taxes, delivery charges and other mandatory fees will be shown before you submit an order. You must use an authorised payment method and provide accurate payment details. Payments are subject to verification by the payment provider. Promotional codes are subject to their disclosed conditions and validity periods. Price changes do not affect an accepted order. If an obvious pricing error is identified before acceptance, we will contact you for instructions or cancel and refund the affected order; we will not charge an increased amount without your agreement.
5 Orders and acceptance
Submitting an order is an offer to buy. An automated receipt or payment acknowledgement does not by itself confirm acceptance. We accept an order when we send an express acceptance or dispatch confirmation. Before acceptance, we may decline an order for stock unavailability, a material listing error, unsuccessful payment verification, suspected fraud or a legal restriction. We will notify you and refund any payment for an order we decline. After acceptance, cancellation by us is limited to rights permitted by law or these Terms and will not remove your remedies.
6 Delivery and collection
Available destinations, delivery charges and estimated delivery times are shown at checkout or agreed before purchase. Estimates are not guaranteed unless we expressly agree to a fixed date. We will notify you of material delays and offer remedies required by law, including cancellation and refund where applicable. Provide a correct address and reasonable access for delivery. Any redelivery charge must be reasonable and disclosed before it is incurred. Risk of loss passes when you or your nominated recipient takes physical possession, subject to applicable law. Ownership passes once full payment and delivery have occurred.
7 Cancellations returns and refunds
To request cancellation, return, exchange or a refund, contact Jason@buildant.net with your order number and a description of the issue. Cancellation before dispatch is subject to order status and any clearly disclosed conditions for customised goods. Any voluntary change of mind return period and conditions will be stated on the product page or at checkout before purchase; no general change of mind right is promised unless stated or required by law. For defective, damaged, incorrect or misdescribed goods, contact us as soon as reasonably possible, with photographs where available. A request for prompt reporting does not shorten statutory rights.
We will assess the issue and provide the repair, replacement, price reduction or refund required by applicable law. We bear reasonable return costs where the issue is our responsibility. Please obtain return instructions before sending goods and package them safely. Original packaging may be requested where available but is not a condition of a statutory remedy. Approved refunds will be made without undue delay, normally to the original payment method; bank or payment provider processing times may apply. Any product-specific voluntary return terms cannot exclude mandatory consumer rights.
8 Acceptable use and submitted content
Do not use the Website for unlawful activity, fraud, unauthorised access, malware, interference with security, infringement of intellectual property rights or collection of other users' personal data without authority. Do not publish false, abusive or unlawful reviews. You retain ownership of reviews and other content you submit. You grant us a non-exclusive, royalty-free licence to host, reproduce and display that content as reasonably necessary to operate and promote the Website and relevant products. Do not submit confidential material or personal data about others without permission. We may remove content that breaches these Terms or the law.
9 Intellectual property and third party services
The Website design, branding, text, graphics and other materials belong to us or our licensors and are protected by applicable law. You may use the Website for lawful browsing and purchasing. Other copying, distribution or commercial exploitation requires permission or another lawful basis. Links and integrations may lead to third party websites, payment services or delivery services. Their own terms and privacy notices may apply. This does not exclude our responsibility for obligations we owe you or for service providers acting on our behalf where the law makes us responsible.
10 Service availability and liability
We take reasonable care to operate the Website but cannot guarantee uninterrupted or error-free access. We may temporarily suspend access for maintenance or security. To the extent permitted by law, we exclude liability for indirect or consequential losses and loss of business profits arising from use of the Website. We do not exclude or restrict liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded. Nothing in these Terms excludes statutory guarantees, rights or remedies, including under the Malaysian Consumer Protection Act 1999 where applicable.
11 Suspension and events beyond our control
We may restrict or suspend an account where reasonably necessary to address a material breach, suspected fraud, security concerns or legal requirements. We will give notice and an opportunity to resolve the issue where reasonable and lawful. Suspension does not remove rights relating to accepted orders or amounts owed. Events beyond reasonable control may delay performance. We will take reasonable steps to reduce their impact, notify affected customers and honour cancellation or refund rights required by law.
12 Changes and general provisions
We may update these Terms by publishing a revised version with a new effective date. Changes apply prospectively and do not alter an accepted order without your agreement unless required by law. We will give reasonable notice of material changes where appropriate. If a provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a right does not waive it. Any separate written agreement or product-specific terms apply only to their stated subject and do not override mandatory rights.
13 Governing law and disputes
These Terms are governed by the laws of Malaysia, subject to any mandatory protections that apply to you. Please first contact Jason@buildant.net so we can try to resolve a complaint. Malaysian courts have jurisdiction, without limiting any right to bring a claim before the Tribunal for Consumer Claims Malaysia or another competent court, tribunal or authority available under applicable law.
